Managing Partner, Matthew C. Scarborough, Esq. successfully prevailed on an insurer’s Motion for Summary Judgment in Pasco County in front of the Honorable Susan Barthle. In a factually horrible case, the corporate insured’s CEO and owner was struck and killed while riding a bike by an Underinsured Motorist. The insurer had a one million dollar UM policy issued to a corporate insured. In underwriting materials and in an insurance disclosure, the insured was listed as an individual. Matthew C. Scarborough successfully argued a violation of the claims administration statute or a notation in the underwriting materials does not change the plain, unambiguous provisions of the insurance policy and as a result, the Class II insured would not qualify for coverage while riding a bicycle.
