Scarborough Attorneys Obtain Yet Another Motion For Summary Judgment Victory

Managing Partner, Matthew C. Scarborough, Esq. successfully prevailed on an insurer’s Motion for Summary Judgment in Pasco County in front of the Honorable Susan Barthle.  In a factually horrible case, the corporate insured’s CEO and owner was struck and killed while riding a bike by an Underinsured Motorist.  The insurer had a one million dollar UM policy issued to a corporate insured. In underwriting materials and in an insurance disclosure, the insured was listed as an individual.  Matthew C. Scarborough successfully argued a violation of the claims administration statute or a notation in the underwriting materials does not change the plain, unambiguous provisions of the insurance policy and as a result, the Class II insured would not qualify for coverage while riding a bicycle.Should you have any questions about this ruling or if we can assist you, please do not hesitate to call or email.
